Ukraine, and subsequently the European Commission, have spoken out in favour of the creation of a special tribunal on aggression in Ukraine. The Nuremberg tribunal considered aggression to be “the supreme international crime” but no one has been prosecuted for the crime of aggression since the end of WWII. The International Criminal Court, which is investigating war crimes in Ukraine does not have jurisdiction to prosecute the crime of aggression by citizens of non-consenting states, a limitation imposed by the United States and other western countries. Proponents say that the creation of an aggression tribunal could decisively rehabilitate the criminal prohibition of illegal war. Sceptics worry that it would consecrate selective justice and reinforce a perception that international justice only kicks in against “enemies” and outcasts.
