Around The Sentence: In Switzerland, can a criminal’s relatives be punished?

The Sentence tells the story of Cindy Shank, who was sentenced to 15 years in prison for being the girlfriend of a drug dealer: in the United States, she is guilty of involvement in a criminal organization. In Switzerland too, according to article 260ter of the Swiss Criminal Code, participation in or support for a criminal and terrorist organization is punishable. The Federal Chambers are currently considering a revision of this standard that foresees the strengthening of the repression not only of members of these organizations, but also for those who only “support” them. How far are we willing to expand repression, criminalize innocuous acts and punish them with prison sentences, in the name of security? What will we choose between freedom or security?
